trying to help a fellow passenger. >> kind of in and out of consciousness. kept asking the same question over and over again like what happened? where are are we he? i kept telling her we are on the train. it crashed. >> right now there is no word on what caused the crash. the ntsb is investigating the tracks because the tracks were so severely damaged. rail service has been stopped. officials say it can take until monday for service to be restored. amtrak which uses the same line suspended service from new york to boston until further notice. it caused a cascading effect of delays and cancellations throughout this entire area. much who are on that coming up here on information this morning. >> unbelievable. train travel is the safest possible way to get from a to b. >> you never think that mistake is going to be made when they are on the same track. >> that is my train that i take home from work. that's the route i take. i think my husband was on

that train not when it crashed. he got off that very train it left grand central at 4:40 yesterday afternoon and, you know, just packed. standing room only because some people are leaving for the weekend. so thats was an intense scene in connecticut fairfield county. >> intense scenes, drama in washington as the former head of the irs shows up on the hill for a grilling from both democrats and republicans over the question of why the irs apparently targeted president obama's political enemies over the period of almost two years. >> yeah, this is outgoing irs commissioner stephan miller. and, as tucker mentioned, democrats wanting answers, too. although they were hoping it wouldn't turn into some sort of political theater. i don't know that they got their wish. certainly the answers were not forthcoming. that is what angered many people yesterday during this testimony. take a listen. >> we were repeatedly told no such targeting was happening. that isn't being mislead.

that is lying. >> this is very chilling for the american people. now i know you are resigning and you are walking away from it, but this is not going to go away. this is a pandora's box that has been opened. i don't think you can get the lid back on it. >> do you believe it is illegal for employees of the irs to create lists, to target individual groups and citizens in this country. >> i think the inspector general indicated it might not be others will be able to tell that. >> what do you believe? >> i don't believe it is. >> i am really concerned. i have got to tell you, with you are sitting you should be outraged but you are not. the american people should be outraged, and they are. >> i'm not arguing that the list was bad and that the list was conservative based. >> then i would say, excuse me i'm going to reclaim my time on this then i would say it's targeted. you can't have that both ways. that's targeting and there is 16 times in this report

that says that there was targeting. >> this is a problem of the irs being too large, too powerful, too intrusive, and too abusive of honest, hard-working taxpayers. >> this is a huge blow to the faith and trust of the american people have in their government. is there any limit to the scope of where you folks can go? >> this is wrong to abuse the tax system. this screams out for tax reform, does it not? >> i think it's an area right for redefinition and reform, yes, sir. >> do you want to know where a lot of this comes from? look at senator levin's letter. senator levin specifically mental add bunch of the groups that you all targeted. you were all doing what democrat senators were asking. >> i just think the american people have seen what's going on right now in their government. this is absolutely an overreach and outrage for america. >> i yield back. fits of applause. mike kelly said you can put anybody out of business if you want to. you are the irs. how scary is that. when the irs comes in there you are not allowed to be showedy. this is an overreach. >> they prevented people from going into business. this is in the middle of a presidential campaign. they hamstrung some of the president's most vocal opponents prevented them from entering into the campaign debate. when charlie rangel head of the ways and means committee does not pay his own taxes is outraged. you know it's a story. >> you know it's bad. >> the woman who was in charge of the tax exempt office during this time from something like 2009 to 2012, his name is sarah hall ingram, moved on to obama care, affordable care act. now they are saying this is the woman who allowed this be on the lookout for targeting list of the tea

party she is going to be the law enforcement officer of who complies with obama care? they don't like that plan. >> do you think? >> this can't stand. you couldn't make this up. it is the woman who oversaw this attack on the president's political opponents is now running the irs arm of obama care? can it actually happen? no. >> well, democrats defending her saying, look, she was gone six months before her subordinates even knew about what was unfolding. democrats coming to her defense and republicans saying that's not true. that time line doesn't mesh she did oversee the subordinates who knew what was going on with the irs. >> let's be clear, there was not a single tea party group to receive irs tax exempt status for 27 months. meanwhile all kinds of left wing progressive groups got their status including flakey ones, a flake charity called the barack

when jodi arias is sentenced? >> well, you know what? some people deserve the death penalty and jodi arias is one of those people. no doubt about it. >> chris, you know, she said in a jail house interview that she would rather be given the death penalty than spend the rest of her life any of a little cell. what do you think of that? i don't buy it. that's jody being jody. she has had guns. she has had knives. she has had plenty of time to take her life if she truly wanted to die. i don't believe that i think that's her doing what she does. that's just manipulating and playing on people's emotions. >> heather, what do you think the likelihood is that jodi arias gets death this week? >> you know, alisyn, in this particular county, highest county for giving the death penalty. do i think that this jury has a strong likelihood of finding for the death penalty. what they have to do is weigh the aggravating factors which is what juan

martinez has already argued the cruelty at this of her act against any mitigating factors that the defense puts on. they have a hard time finding any mitigating factors for jody. they will note she is a good friend and artist. take that against the emotion you have heard from the family on wednesday. it's going to be a very tough tough argument for the defense. >> chris, how is travis' family reacting to the verdict and what do they want to see happen this week? family elated up to this point. can i just tell you that 8 out of 8 of them of the siblings or i should say seven out of 8 now that travis is gone. seven out of the 8 of them want the death penalty. this has wrecked their entire family. she didn't just kill him, she killed him in a barbaric way and she has gone on to kill him even now after all these years she is still killing him, his reputation, and all

down? stephan haze was on "special report" and talked about where benghazi goes now. >> pattern claims by jay carney and hillary clinton among others that the white house, the state department made a single adjustment to the talking points. simply not true. i am surprised that some in the mainstream media are not taking more umbrage at the fact that they were lied to so directly about something like that. more broadly, i think the next big question is how do we get the movie? where did the movie enter this discussion? it wasn't in any of the talking points. it was mentioned in passing, not in any of the actual email discussions in the nearly 100 pages of emails but in passing, on the first page and again on the last page as part of a subject line of an email. we need to know more about how they settled on the story to sell the movie. >> interesting point right in the middle of that which is jay carney, long-time reporter for "time" magazine stands up in front

of his former colleagues in the press corps and flat out lies, flat out provablably lies and says there was just minor change made to the talking points. they are not offended? they are not outraged? they are not besieging him with questions at the podium? why aren't they madder? the white house press secretary is not supposed to lie to reporters that's not conventional. >> alisyn: not part of the job description. part of that arb, accountability review report, four people lost their jobs, sort of or were put on administrative leave. we now know from a state department spokesperson this week that in fact they are still collecting their paychecks and she couldn't tell a reporter whether or not they have to still go into the office or if they can be sitting on a beach while collecting their paycheck. >> that's nice. >> clayton: that's nice. >> tucker: unbelievable. >> clayton: only in the government could you have this level of a problem in the workplace and still get paid for it and then not have to go to the office. >> tucker: they don't do that here at fox, do they? >> alisyn: no.

so don't mess up. no pressure but don't screw anything up. we have a fox news alert we want to get to right now. we have breaking news out of new jersey. a plane was forced to make a belly landing overnight at newark international airport after its landing gear malfunctioned mid-air. you can see this all unfolding right here on your screen. this happened shortly after the u.s. air waist flight took off from philadelphia. 31 people were on board. sparks flew as the pilot landed. crews quickly doused the flame with foam. fortunately happy to report no one was hurt. o.j. simpson' plea new trial now in the hands las vegas judge. he wants 2008 thrown out blaming lawyer for blowing the case. simpson's former attorney on the stand refuting most of simpson' testimony. for one he said he knew his accomplices had guns during the robbery. >> i handed it over to him and i said what are you talking about?

were camera men in front of us so i just caught it. >> clayton: you hold this bird do you have an affinity for this bird because i caught this little guy do you let him go? >> alisyn: is he a now a pet? >> we actually let the bird go at that point he was kind of cute so we let it go. >> alisyn: what i like is your reaction. i like your triumphant fist pump. i got it. >> yeah, i was so shocked that i actually caught this bird that the first thing that went through my mind is that i just did something that my grand kids are probablgoing to talk about. natural reaction was like yes. this is the dream. i have spent a an awful lot of time quail hunting and nothing like this has ever happened to me or anyone i know. the birds usually run away from you. is this some sort of vine favor. >> absolutely i'm a pastor that's how it works, right? no. i have been hunting my whole life i have never seen it happen or heard of it happening it was a fluke thing. >> alisyn: other great thing was your buddy's reaction to this.

night's evening rush hour 60's people taken to the hospital. at least five with injuries. >> take a look at the pictures. show the mangelled mess of metal inside the trains. seats on top of seats. even the roof collapsing in some parts. governor dan maloy says the impact caused an awful lot of damage. >> it's clear that these cars came into contact, ripped off at least a portion of siding of one of the cars, extensive damage in the front. and the wheels are sticking into the other train. >> the tracks were so badly damaged the rail service on the metro north railroad has been stopped for now. officials say it could take until monday for service to be restored. amtrak also uses the same track line and has suspended service from new york to boston until further notice. we will continue to stay on top of this story and try to find out answers how to how that has actually

unfolded. >> alisyn: let's get to the scandal deyour in washington. and that is the irs and how they came to target grilled four hours in front of this congressional committee yesterday. very little light ended up being shown on what happened, who was responsible for the targeting, who sent the be on the lookout edict down for any paperwork that said tea party. he did a somewhat masterful job of knowing nothing. >> tucker: a display of arrogance at really the highest level. >> clayton: when asked about specific names couldn't find the names. he is the head of the group by the way. couldn't find the names. it wasn't targeting. he found that term basically offensive even though that was in the report that was released that they were targeting, even they used that word and came out in that report. on and on and on this went

yesterday. >> tucker: you show up, as you just said, you show up for a congressional hearing, you know what you are going to be asked and you don't have the names of the people responsible? >> clayton: right. >> tucker: what are you thinking? that's not oversight that's evasion. >> he admits he says i will be happy to look into it for you. >> tucker: look into it? you are in the middle of a congressional hearing that's the whole point. >> clayton: due diligence. >> alisyn: give you a sample of what went on yesterday. >> i do not believe that partisanship motivated the people practices described in the inspector attorney general's report. i reviewed the attorney inspector general's report. i think what happened here is that foolish mistakes were made by people trying to be more efficient in work load selection. >> inspector general report says that no one acted out of malice or political note investigation. mr. george, i want to know, do you still stand by that? >> we have no evidence at this time to contradict

that aversion, sir. >> if the targeting wasn't targeting, if the targeting wasn't based on philosophy, how's come only conservatives got snagged? >> they didn't, sir. organizations from all walks and all persuasions were pulled in. >> did you have targeting lists that contained words like progressive or organizing in their names? >> we collected, to be blunt, more than tea party cases. >> no progressive or organizing buzz words that were used for targeting; is that correct? >> that's correct. >> alisyn: you heard congressman ryan there. >> unbelievable. >> alisyn: you say it was across the political spectrum. that's interesting. why weren't there any liberal groups with names like progress or progressive or organizing or liberal, some of the groups that we know have those things in their names but they weren't flagged. >> we know this is a flat out lie. for 27 months not a single tea party group received irs tax exempt status. we know during that imsa period -- by the way this is in the run-up for a

presidential campaign. and these were the groups owe posing the president's agenda and re-election. by hamstringing them of course the obama campaign helped. all kinds of liberal, progressive groups were fast tracked including the barack h. obama foundation which isn't even real got its clearance in 32 days don't tell me no politics were involved. >> clayton: no politics involved. >> tucker: i'm sorry it winds me up even at 7:06. >> clayton: why did that report come out and apologize for it and then come out and saying no politics involved in it seems absurd. those same tea party groups that were targets. the woman putting of obama care. this is the woman that will oversee the health and well being of this country as it relates to the irs. going after implementing obama care in the tax code. she is sarah hall ingram. she from 2009 to 2012 was in charge of this very department.

she oversaw these particular individuals who were, in fact, doing the targeting of these conservative groups. so, you can imagine how outraged these conservative groups are this morning when they are finding out that the woman who targeted them is now in charge of obama care overseeing the health and welfare system. >> alisyn: making sure you comply with obama care as a business. otherwise they will crack down on you and levy fines. >> what is -- how are they to believe that they won't then be targeted? >> alisyn: that is the question. >> tucker: what are you some kind of militia member? you don't trust the government? you don't trust sarah hall ingram to keep your data safe and not crush you if you oppose the president's agenda? >> alisyn: she has impressive pedigree, clayton. she went to undergraduate at yale. she went to law school at georgetown in -- she graduated in 1982 began her career with the irs in the former tax litigation division. that sounds exciting. she was the deputy commission everywhere of the tax exempt government

entities division. that's the one that she was in charge of from 2009 to 2012. the tax exempt division, which is where all of these problems cropped up. >> clayton: she got bonuses by the way during the time when this was all unfolding, when they knew about it even during the period you might forget 2009 or 2010. even during the 2012 period when she received i think it was $26,000 bonus -- no, i'm sorry, yeah, $26,000 bonus during that time period, that's when it was on the books that they already knew that this was unfolding in 2012. >> tucker: then she got promoted. >> promoted to this job. >> tucker: this can't stand. you can't actually have someone who was at the center of this unfolding scandal. and, by the way, it's just beginning. running the irs component of obama care. that cannot happen. going to have to relieve her of this post. >> clayton: democrats were furious calling on the white house to do something to take action on this.

so the president comes out and says that the acting commissioner there stephan miller is resigning. okay. that's action. >> alisyn: he was only the interim commissioner. >> clayton: he was going to be gone in a month anyway. if you are the administration trying to put a lid on this and put out this fire do you go and do this? >> alisyn: also helpful if we could ever get to the bottom of who issued the be on the lookout order. steve miller who was on the stand for four hours was asked that' and he couldn't come up with one name. >> tucker: still have not released the names of the groups who were targeted. 280 some groups denied tax exempt status they still have not to this moment released that list. why not? >> clayton: it is really bothersome. much more on this coming up with great guests on the show including governor huckabee. >> alisyn: you can find us on twitter if you would like to vent. get to your headlines. >> plane forced to make emergency landing overnight at new new jersey's new jersey

holder who insists the records were seized because americans were at risk. and during a series of questions, holder even went on to say he had no knowledge of the investigation or the decision to seize the a.p. phone records in the first place. the decision to issue this subpoena made by the people involved in the case. the matter is being supervised by the deputy attorney general. i am not familiar with the reasons why -- why the subpoena was constructed in the way that it's. i'm simply not a part of the case. >> but that's a very different story from what we're hearing from the a.p. editor. they are firing back. the company's attorney wants to know why months later the administration went after the phone records much reporters and editors allegedly tapping home, work and even cell phones in a statement the news agency claims to have worked with the white house on the piece. even holding the story for approval. they have released a statement and in part it reads: until the government assured us that

does he understand that the irs does not have the right to invade people's privacy, ask them for their thoughts, ask them for their prayers, ask them for who they associate with. i mean, the violations of fundamental constitutional rights of americans are legion in all of this. for him to sit there and smirk toward these congressman who have ever right to answer ask him those questions and demand an honest answer i thought was repulsive. if i had been president obama watching that performance, i would have made sure that he didn't get to wait until june for his resignation, he would have been packing his cardboard box and escorted to the door that very day. >> tucker: he is getting paid. >> yes, he was. >> tucker: i don't understand how someone can get called up before a panel like, this he knows he is going to be asked who is responsible. he didn't even try. he said i have no idea. maybe can i get that information. are there going to be criminal charges? >> there should be. the only thing that would be, i think appropriate at this point. the next time that we see

worked with interns there are indeed a lot of commonalities. young person in many cases working unpaid or very low paid. often out of college or just in college. a lot of commonalities. the decision does leave that core issue whether intern should be paid for real work is divided. >> i'm of the opinion. i think i had three internships during college none of which i was paid for. the hands on experience i got was incalculable. i couldn't get to do the full job the other individuals were doing but i did get college credit and i thank those internships for giving me the foundation to go off and work in a career in broadcasting. >> clearly there are lots of valuable internships out there. for young people this is the major or principle way into certainly the kind of white collar workforce at this point. what's happened in recent years and become particularly clear over the last five years the recession and record levels of youth unemployment this kind of internship has gone off the rails. people are being expected to do more and more real

work. >> clayton: you think companies are taking advantage of them. >> many firms are. and, you know, we have a situation now where there is a culture of unpaid work which has relaced this fundamental ethic of a fair wage for a hard day'swork. >> clayton: however, these companies though are giving them an opportunity of knowledge and, in fact, maybe an opportunity down the line to be hired as a full-time employee. isn't this part of as critics would say an entitlement generation. kids feel entitle the sort ofs wouldification of america where kids can get money doing a little bit of work as an intern where in years pass. >> junk we can talk about wussification. record levels of student debt and prospects of downward mobility and now this sort of requirement to do three, four, five or more unpaid internships for many people. i mean, when i, you know, went to unpaid internship myself i mentioned what i was doing to my parents and they said you are working

private lives and professional lives were tapped into. this to me is inexcusable and trampling on the constitution. >> florida republican trail who was a former reporter reintroduced the free flow of information act to protect reporters and their sources, says specially in the wake of the associated press' reaction. the company's attorney wants to know why months later the administration went after the phone records of reporters and editors, allegedly tapping home, work, and cell phones. in a statement, the news agency claims to have even worked with the white house on the piece. even holding the story for approval. the president says he is open to a, quote: conversation about laws protecting reporters and their sources. >> to the extent this case has prompted renewed interest about how do do we strike that balance properly, and i think now is the time for us to go ahead and revisit that legislation. i think that's a worthy

>> alisyn: pickerring said he would testify before issa's committee in public. congressman wants a closed door session first. colorado sheriffs are suing the state over new gun control laws. the sheriffs claim the legislation violates their second amendment right to bear arms. the laws, which are scheduled to take effect in july limit how much ammunition people can buy and require anyone who wants to buy a gun to submit to a background check. legislation coming in response to shooting massacres in a colorado movie theater and connecticut elementary school last year. a new mexico state trooper is being hailed as a hero for rescuing a little girl pinned under a large suv. he tried to lift the vehicle off himself but he could not. so he got four bystanders to pitch in and together they were able to lift it up enough to get the 8-year-old girl out. the child last listed in serious but stable condition. what is a bird in the hand worth? apparently an amazing viral video.

>> alisyn: stunning surprise? week. actress angelina jolie announced she underwent double mastectomy after receiving knowledge she had gene. our next guest has been faced with having to make this life saving decision. here to share her story is the president and executive director of the frazier foundation. michelle mcbride and frazier is the wife of fox news channel producer woody frazier. michelle, great to see you this morning. >> hi, good to he see you. thank you. >> alisyn: tell us about -- discovering that you too had the so-called braca jean and how hard the decision for double mastectomy was for you it? >> was extremely difficult decision. when i first found out that i had the gene, the first thing i did is try to figure out well, what are my options? what can i do? surgery is not the only

option. and, in fact, i waited to have surgery because i still wanted to have another child. so, i began an increased level of screening. when you are at an increased risk, you can have mri and sometimes an ultrasound of the ovaries on top of your annual mammograms that you would be getting. and so i started with that. as a way to help detect cancer early should i develop it. but i spent a lot of time researching my options. i met with medical centers and teams across the country. >> alisyn: yeah. >> and researched online and spoke to a number of women before me who had done it, before i made my decision to have a double mastectomy. >> alisyn: michelle, it's interesting to hear that. i didn't really know you did have any options. once you are diagnosed and the gene is detected. for instance angelina jolie's mother died of owe

ovarian cancer when she was 56. she was diagnosed 46. why didn't angelina wait a few years, several years. she did it at 37 years old. it's interesting to know that she had other options. she could have just been monitored for a while. >> that's a good question. of course, i don't know angelina personally so i can't tell you what exactly went through her mind. i can tell you that doctors say in terms of your own cancer risks of onset, when you come from a family of cancer patients, you can expect to develop cancer 10 years prior to when your, you know, your mother had had it. so angelina was probably looking at it that way. if my mom was diagnosed with cancer at 46, i could get it around now i didn't know it. that's a great point. your story had a happy ending and resolution for you. after you had the double mastectomy you knew that your decision was the right one.

>> yeah. you struggle and you struggle with it it it's not an easy decision. and even immediately after i had the mastectomy i doubted whether i did the right thing. because it's scary and it's awful and it's emotional. but afterwards, after meeting with my doctor. i learned that the pathology came back on my breast tissue and that in fact, i had had cancer that had gone undetected in my left breast. >> alisyn: incredible. >> and the surgery got it all it was incredible. >> alisyn: what a good resolution and closure for you. michelle mcbride. thanks for sharing your personal story. we appreciate the brave you of you and people like angelina jolie. thank you. >> thank you. >> alisyn: how a thief got away with goods worth a million dollars. was this an inside job? you have made memorial days yet? take a trip where you can get the best deals still. right now, last minute.

connecticut last night. two trains were packed with commuters. they were coming home during rush hour last night. 60 people were taken to the hospital as a result of this crash, and at least five of them have critical injuries, but we are told this morning the majority of victims have been treated and released. >> take a look at these pictures captured inside the train. it shows mangled mess of metal inside the train seats there with roofs on top of the people, the roof collapsing on other parts of the train. a man who was on one of those trains describes trying to help a fellow passenger. >> he was kind of in and out of consciousness. kept asking the same question over and over again like what happened, where are we? i kept telling her we were on the train, it crashed. >> cleanup at the site of that crash is expected to take days, maybe weeks. rail service in the metro north railroad has been stopped for now. the goal is to get things back on track by monday. we'll see. amtrak, which uses the very same rail line, has suspended its

service from new york city to boston indefinitely. >> investigators are on the scene and we'll keep you posted for the next hour as to what they uncover and how this could have happened. meanwhile, we're following this story for you. of course, if you're watching fox newschannel yesterday, you saw the grilling unfolding on capitocapitol hill as the former the outgoing, i should say, commissioner of the irs, stephen miller, was being grilled by members of congress yesterday over exactly what unfolded and how in the world the i r s managed to target conservative groups. he was grilled on both sides by both democrats and republicans. democrats were hoping at one point to try to not turn this into some sort of repeat of the 2012 election, but i don't know if they got their way. >> we put together a montage, a couple minutes long. we think it's worth it. the hearing was four hours long, but this gives you a sense of the drama yesterday here in washington. here's stephen miller trying to defend himself and the irs. watch. >> we were repeatedly told no such targeting was happening.

that isn't being misled. this is lying. >> this is very chilling for the american people. i know you're resigning, you're walking away from it. this is not going to go away. this is a pan dora's box that has been opened. i don't think we can get the lid back on it. >> do you believe it's illegal for employees of the irs to create lists to target individual groups and citizens in this country? >> i think that the treasury inspector general indicated it might not be. others might be able to tell that. >> what do you believe? >> i don't believe it is. >> i am really concerned. i've gotta tell you. where you're sitting, you should be outraged, but you're not. the american people should be outraged, and they are. >> i'm not arguing that the list was bad and that the list was conservative-based. >> then i would say -- excuse me, i'm going to reclaim my time on this. then i would say it's targeted. you can't have that both ways. that's tacialtd and there are --

targeted and there are 16 times in the report that it says there were targeting. >> this is a problem of the irs being too large, too powerful, too intrusive on honest, hard-working taxpayers. >> this is a huge blow to the faith and trust the american people have in their government. is there any limit to the scope of where you folks can go? >> this is wrong to abuse the tax system. this screams out for tax reform, does it not? >> i think it's an area ripe for redefinition and reform, yes, sir. >> do you want to know where a lot of this comes from? look at sandra levin's letter. senator levin specifically mentioned a bunch of the groups that y'all ta targeted. y'all were doing what democratic senators were asking. >> i think the american people have seen what's going on in their government. this is disliewlt a absolutely h and an outrage for america. >> by the way, we should mention the congressman there, mike kelly who you heard get the loudest round of applause will

join us here tomorrow on the show. one of the things he said ant wanted further to say is the irs is forcing businesses to not be able to open or to close as a result of what seems like a very draconian use of this institution. >> and remarkably, steve miller who you saw on the stand there, the interim commissioner of the irs, he didn't like the word targeted. he was stuck on a semantics point. he was like i find that to be a perjorative term. i wouldn't say we were targeting. the amount of parsing, tucker, you sometimes give clayton and me grief for living in new york because there's so much regulation. in washington, dc where you live, the amount of parsing of words where they spent time on during these four hours yesterday. >> this was just poor customer service, mr. miller described it yesterday. just to be totally clear, this was a political operation. this took place within the context of a presentation campaign. this had the effect of hamstringing the president's political opponents during that

campaign. to say there was no targeting flies in the face of the facts. here's one. during a 27-month period, at the height of this, not a single tea party group got tax-exempt status from the irs. during that same period, left wing group after left wing group got their applications expedited. a sham charity in alex andyia, virginia, they don't do anything. they got their application rubber stamped in 32 days by lois ler ner herself. >> by the way, i called for my own amusement on friday. >> you prank called it. >> yes, i did. no one there, doesn't exist. the answering machine says welcome to the barack obama foundation. they didn't pronounce the president's name directly. >> maybe it's somebody different named barack obama. furthermore, we've had some guests from the tea party who tried to get tax-exempt status.

they said the irs wanted their e-mails, the irs wanted their donor list, all sorts of loot that they had to go through. >> a number of people came forward including on the air here at fox to say they were audited by the irs, the most terrifying ordeal of all, including one businessman truly who supported mitt romney's campaign. he was highlighted in an anti-obama ad, and immediately after found himself audited three times in four months. if that's not a horrifying abuse of government power, i don't know what it is. >> conservative groups are angrieangrier over who the white is putting in charge of the i r s portion of obama care. they will se oversee these agen. sarah hall ingram. her history goes back to 2009 when she was at the head of the irs overseeing these very individuals who we now know had targeted conservative groups. furthermore, she had been promoted and given bonuses throughout this entire period.

>> she was in charge of the tax-exempt status division which is exactly what this falls under, and you can see that she got many bonuses during the time that this was happening to the tune of something like $100,000, so now obviously republicans are very concerned she will be the very person at the affordable care act who will make sure that businesses comply. well, will she only be looking at conservative businesses and making sure that they adhere to the letter of the law while granting waivers to liberal businesses? i mean, these are the questions being raised today because they all seem to be political. the decision making. >> she can't run it. the government in part runs on trust. we send our money in every april 15th with the expectation we're all going to be treated equally under the law. as soon as that trust erodes, and in this case evaporates with good reason, the whole system comes apart. that's an attack against the rule of law. this woman cannot remain in that job, and i don't think she will. >> let us know how you feel about it. mike kelly will be on the show

tomorrow with more on the hearing. there's another fox alert for you right now. a plane has been forced to make an emergency landing overnight at new jersey's newark international airport after one of its landing gears malfunctioned in mid air. the scary scene was caught on camera. you can see it there. it happened after the u.s. airways flight took off from philadelphia. sparks flew as the pilot performed this deli landing and crews quickly doused the plane with foam as you can see. fortunately, none of the 31 passengers on board was hurt. there were some frightening moments at the the cannes film festival in france. a man fired a gun near the outdoor studio during an interview. you can see everyone running for cover. fortunately the gun did not have real bullets and no one was hurt. there was more trouble the night before. thieves pulled off a million dollar jewelry heist at a hotel just blocks from the red carpet. the safe was ripped right out of the wall. police think the theft was an

touching down, a new tornado in texas. preliminary reports say as many as two notr new tornadoes have struck. no one with was injured. let's get more details on this. all seven of the people missing after those initial 16 tornadoes have been found. that is good news. officials say residents of ranchos brazos in granberry can return home starting today on a limited basis to survey the damage there. texas governor rick perry was in granberry getting a firsthand look at the widespread devastation. let's brick in rick reichmuth for a look at the storms. >> the storms are incredible. a small area of ef-storms moved through grandbury. in fact, very heavy rain is falling in areas around talladega seeing 4 to 6 inches of rain overnight causing flash flooding right there ongoing at this moment. it may be another inch or two of rain falling from that. no severe weather with that storm. out across areas of the west, a new storm is pulling on here, very cold air going to be moving

garage in d.c. with deep throat getting information about watergate. what has changed? >> technology has changed. what the justice department does in terms of investigations, that hasn't changed. what changed is people are using e-mails, cell phones, there's nor surveillance around so that the government can track if you mail a letter because it's probably a camera at the post office. they can go back and see well, did you actually put the mail in. there have been a number of cases where even when encrypted e-mail has been used to presumably protect even from the nsa from breaking into it, but the government goes to the provider, the internet provider, serves a subpoena and grabs the hard copy mail. the encryption is useless for that person. that's what has changed. i represented throug representee '90s and 2000s many people investigated for classified leaks, cases that wouldn't go anywhere because the government couldn't find evidence. now they find evidence. >> the posture of the press has

>> i've got to be honest. a lot of the stories came from real instances that we talked about or gossip that you heard about on the red carpet. of course, i changed it and pulled it all together and made a fun little romantic comedy in there. >> alisyn: will we recognize people in it, th? >> the people who it happened to will recognize it, yeah. >> alisyn: i'm waiting for the tweets today like ali, i'm like what, that's not your name. no one will never know. don't say anything. you're not a red head. let's talk about the biggest loser now in it' its 15th seaso. >> yes. > >> alisyn: do you feel pressure on the show to stay in shape and stay thin? >> i pressure myself that i want to live the biggest loser loser lifestyle. i think their message is fantastic, our message is fantastic. we talk about being healthy for the rest of your life and the tools that you can help you do that. i put that pressure on myself. i stand on the scale and i weigh these people in and they're

>> alisyn: we want to thank the hellcats of west point for being with us this morning and helping us sel celebrate armed forces d. they sound great. meanwhile, america was in danger. that's the reason u.s. attorney general eric holder said the justice department seized two months of phone records from journalists at the associated press. fox's elizabeth prann is live in washington with more. hi, elizabeth. >> reporter: in reaction, you have lawmakers on one side who want an inspect investigation into the justice department seizure of ap phone records while others want congressional hearings. this week we heard from attorney general eric holder who insists the records were seized because americans were at risk and during a series of questions he went on to claim he didn't have any knowledge of the investigation or the decision to tap the phones. ap editors and reporters, however, have a very different story, saying that their phones were tapped months after, and in a statement the news agency claimed to have worked with the white house on the piece, even holding it for approval. now we're seeing movement on capitol hill along with two pieces of legislation that's

korean military officials. they say the intent is unclear. south korea says it's on high alert in case of any other military action. o.j. simpson's plea for a new trial now in the hands of a las vegas judge. simpson wants his 2008 hotel heist conviction thrown out, claiminblaming his lawyer for bg the case. his former attorney refuting most of simpson's testimony. for one, he said simpson knew his accomplices had guns during the robbery. >> i mean, i went over to him and i said what are you talking about? what are you doing? >> simpson gave up attorney-client privilege so his attorney could testify there. no word on when the judge will issue her ruling. is michael phelps planning a comeback? a tv station in fort myers said the olympic sensation wants back in the pool for the 2016rio olympics. he said he was hanging up his speedo for good after the 2012 london games. phelps was trying to throw water

on the rumors, saying on twitter why do i keep getting text messages about coming back? do people really believe everything they hear or read? not exactly a denial. what do you get when you combine bungee jumping and basketball? well, an incredible shot that you have to see to believe. even lebron james would have been proud of that one. this guy jumps off a 100 foot tower in georgia and drains a shot on the way down. take a look again. you'll see nothing but net, baby. it took a group of friends about 200 attempts before they finally nailed it. that's a way to kill an afternoon there, rick reichmuth. >> yeah. let's do that. let's work on that. i wonder how many attempts it would take. probably a few more than that. we have big weather stories going on this week. for one, we've got a big horse race going on tonight. take a look at the weather maps.

you can see the preakness expecting 55 degrees after 6:00 at race time, and we're going to see winds maybe up to about 10 miles an hour. a few showers in the area. that's today. now we're also going to be talking about the worst side of things. that's the severe weather that we have. dew points are already high. this is kind of the first time we've seen this so far all season long. we barely had any tornadoes. we're about to see all of this change. the dew points in place, and a big piece of energy coming through the jet stream across areas of the rockies, and it's going to hit all of those very juicy conditions, and we're going to be looking at some severe weather today. this afternoon, especially and into the eke and the overnight hours, where you see the red is the biggest threat to for tornadoes. anywhere in the yellow we could see the echoes across minnesota and north dakota, down towards areas of texas as well. tomorrow i think will be an even worse day, a bigger threat. right now the storm prediction center has issued a moderate risk where you see that red from around kansas over towards joplin and tulsa, down towards oklahoma city.

i can see that being increased to a high risk later on today or tomorrow morning. areas there continue to watch. monday, still dealing with the threat. it's a three-day event and likely we're going to be seeing some significant tornado outbreak. we'll continue to watch that all day long in the fox weather center. right now, ali, what is going on? it's the annual kayak time? > >> alisyn: in fact, it is. the great american kayak race has become tradition on "fox & friends". this weekend we continue with that venerable tradition. we're back with alan treadwell at bass pro shops. nice to see you. >> great to be here. we're so excited that bass pro shop has the go outdoors event going on now. we have free seminars and demonstrations, fun for the whole family. >> alisyn: pretty exciting but almost as exciting that one of my co-hosts will go in the drink in a few minutes. >> truthfully, i have my fingers that will happen. these kayaks are very stable. these are great kayaks. during the go outdoors event, these are under $400.

>> alisyn: all right, at the moment, tonight's big powerball prize is the second-largest jackpot in history. it stands at a whopping $600 million. >> tucker: from being an instant lottery created millio millionat as easy as it sounds. steve white won the largest jackpot in pennsylvania history in 2004. he joins us now. steve, thanks for joining us. the most obvious question is how did you remain normal? you hear horror stories about people winning the lottery, their dreams come true, their lives collapse. yours didn't. why? >> i guess that's open to interpretation, but i have a very good team of people that

keep us grounded and keep us directed and focused and you know, my family is -- my family is very strong. we also believe, you know, if you're not happy before the money, the money is not going to make you happy. you have to be happy before it happens. otherwise, you're headed for a bad road. >> tucker: you have some tips. if someone wins tonight and doesn't go on to become a billion dollar pool of money, if someone walks away with that tonight, you say don't rush to claim the check as your first tip. why not? >> well, because there's so many things you need to do behind the scenes before that comes out. i see winners over the last eight years, and they come out the next day, and the first thing i say is oh, they're in trouble because you can't -- there's so much due diligence that needs to be done before you claim that prize. and the money's not going anywhere, and you need to have all your ducks in a row before you come out and literally flip your life on. that's what happens. >> alisyn: i'll lose the ticket if i wait too long.

so i've got to race there. >> tucker: you thoughted this through. >> alisyn: this is what i didn't think through. visit local law enforcement. why? >> you know, it's funny. at the time my kids were in high school. it was brought up about some of the potential catches that are out there, and so i wanted the low law enforcement to know -- the local law enforcement to know this was happening and where my kids were so they had access to support that they needeneeded regardless of wherey were. they need to be aware of it. they absolutely do. then when you announce, you need to have them on staff because i mean, we had probably a thousand media on our front step within about 10 minutes of our press conference. >> alisyn: oh, my gosh. >> tucker: you say meet with attorneys and accountants as another tip. >> yeah. i mean, certainly with any lottery jackpot and certainly $600 million, there's quite a lot of thought that has to go into this.
